New Delhi: The Supreme Court on Monday quashed the conviction of six men for murder and rape of the eight-year-old child on the Delhi train, observing that there is a “higher standard of proof” for acquittal.
“If there is no evidence of the child being murdered or sexually abused, the legal presumption is that the child is an unharmed victim,” Chief Justice Ranjan Gogoi said in the judgment, which was announced at a bench hearing as a “bulletin”.
The judgment, based on its consequences, effectively ends a multi-year legal tussle — with various states, the Centre and the Supreme Court arguing over the appropriateness of rape convicts being awarded the highest punishment under the law — over the Delhi incident.
Under “bastardy” law, the maximum sentence for rape is life imprisonment.
The apex court verdict imposes a three-year sentence on each of the six convicts for the crime of rape.
“The pre-supposition that the child was an unharmed victim disappears. In such a case, the very idea of reopening the investigation against the accused is wholly undesirable,” the court said.
“The phrase ‘he/she (unharmed) must not have been guilty of any mistake’ means: the presumption is that the child was not guilty of any mistake and that the child, as an unharmed victim, would not have had any animosity towards the accused. Such a presumption is at variance with the presumption of innocence,” the court said.
The high court had in 2018 rejected the eight-year-old’s statement that she was “not sexually assaulted” in the incident and quashed the convicts’ conviction and sentenced them to the maximum punishment.
On October 3, 2019, the apex court, in a 3:1 judgment, upheld the high court’s decision.
The court in the latest judgment said, “The presumption of innocence remains inviolate even if the accused is an accused of rape”.
The high court, in its verdict, had held that the disclosure of the child’s statement ought to have placed “obligation on the prosecution to reopen the investigation or produce as evidence, if it had any, the mobile phone, on which the statement was recorded”.
The apex court held that since the prosecution did not provide any such evidence, the presumption of innocence “is not destroyed and therefore the presumption of innocence remains unshaken

Join us on Sunday 18 March for a day of fun, celebration and a celebration of all things noodle and cookbook related.
There will be fun activities for all ages including games, fun prizes and door prizes, demonstrations and pop up shops. Also on show is an interactive exhibition on food and the ancient history of noodles.
The Museum is home to the largest collection of recipes, cookbooks and cookery equipment in Scotland, and will be joined by the Glasgow Cookbook Club and a selection of international and Scottish publishers in displaying examples of their work.
There will be a demonstration of Thai noodle-cooking, a cooking workshop for children and a demonstration of ancient craftsmanship by the Glasgow Kitchen School.
Commenting on the day, Martin Wright, Director of Glasgow Museum of Transport said: “Glasgow Museum of Transport is delighted to be hosting this event which celebrates all things noodle related.
